These Terms of Service (“Terms”) govern your access to and use of the Zuke website and mobile application (collectively referred to as the “Platform”). Please read these Terms carefully before using the Platform.

Acceptance of Terms

By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Platform.

User Eligibility

You must be at least 18 years old or have reached the age of majority in your jurisdiction to use the Platform. By using the Platform, you represent and warrant that you meet these eligibility requirements.

User Accounts

To access certain features of the Platform, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate and complete information when creating your account.

User Content

The Platform may allow you to submit, post, or share content, including text, images, and other materials (“User Content”). You retain ownership of your User Content, but by submitting it on the Platform, you grant Zuke a worldwide, non-exclusive, royalty-free license to use, modify, adapt, reproduce, and distribute your User Content to operate and promote the Platform.

Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Violating any applicable laws, regulations, or third-party rights.

  • Impersonating any person or entity or providing false information.

  • Harassing, stalking, or harming others.

  • Uploading or transmitting viruses, malware, or any other malicious code.

  • Interfering with or disrupting the integrity or performance of the Platform.Engaging in any fraudulent or deceptive activities.

Service Providers and Transactions

The Platform allows users to connect with service providers and engage in transactions. Zuke does not endorse or guarantee the quality, safety, or legality of the services offered by the service providers. Any transactions or interactions between users are solely between the parties involved, and Zuke shall not be held responsible or liable for any disputes, damages, or losses arising from such interactions.

Intellectual Property

The Platform and its contents, including but not limited to logos, trademarks, texts, graphics, and software, are the property of Zuke and are protected by intellectual property laws. You may not use, reproduce, distribute, or modify any of the Platform’s content without prior written consent from Zuke.

Disclaimer of Warranties

The Platform is provided on an “as is” and “as available” basis without any warranties or representations, expressed or implied. Zuke disclaims all warranties, including but not limited to the accuracy, reliability, and fitness for a particular purpose of the Platform.

Limitation of Liability

To the maximum extent permitted by law, Zuke and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or relating to your use of the Platform.

Modification and Termination

Zuke reserves the right to modify, suspend, or terminate the Platform, or any part thereof, at any time without prior notice. Zuke may also modify these Terms from time to time. Continued use of the Platform after any such modifications shall constitute your consent to the updated Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and Zuke regarding your use of the Platform and supersede any prior or contemporaneous agreements or communications.
